Shangdao Brand Coffee is about to fully exit the Hangzhou market

In Hangzhou, the most popular coffee on the island will be completely withdrawn, replaced by cross-strait coffee. This was revealed yesterday when Hangzhou Shangdao Coffee Food Co., Ltd. issued a related statement.

At present, there are four other coffee shops in Hangzhou that hang the signboard “On the Island Coffee”. According to Jin Meiyang, the legal representative of Hangzhou Shangdao Coffee Co., Ltd. (Hangzhou Ueshima), the copyright holder of the "Ueshima and Tutto" art works is Chen Wenmin, and the right to exclusive use of the copyright is Shangdao, Hangzhou. However, there are hundreds of licenses for the coffee on the island is Shanghai Shangdao Coffee Food Co., Ltd. (Shanghai Shangdao).

What kind of relationship is between Hangzhou Shangdao and Shanghai Shangdao?

In 1986, Chen Wenmin’s “Ueshima and Map” trademark was registered in Taiwan’s Intellectual Property Bureau. On July 10, 1997, Tianjin Guangtai International Industry & Trade Co., Ltd. applied to the Trademark Office of the State Administration for Industry and Commerce for registration of “Langdao Characters and Graphics” and was approved. On May 30, 2002, the company transferred the trademark to Shanghai Shangdao Coffee Food Co., Ltd. (Shanghai Shangdao).

Since 2003, Hangzhou Shangdao and Chen Wenmin have started marathon lawsuits with Shanghai on the island. On July 22, 2005, the second instance of the High Court of Beijing ruled that Shanghai Shangdao infringed Chen Wenmin’s copyright. Zheng Jindu, the director of Zhejiang Liuhe Law Firm, said that the verdict means that Shanghai Shangdao has lost its exclusive right to use trademarks on the island and map. Hangzhou Shangdao and Chen Wenmin are now accepting the trademark registration of “Upper Island and Map” submitted by the Trademark Office of the State Administration for Industry and Commerce. On March 6, the lawsuits of Hangzhou Shangdao and Chen Wenmin suing the four Hangzhou coffee shops have been accepted by the Hangzhou Intermediate People's Court. The object of the lawsuit will affect all the island coffee franchisees authorized by Shanghai Shangdao.
