U.S. Amendment to the Children's Products Flammability Test Certificate Acceptance Terms

The Consumer Product Safety Commission of the United States is currently amending the terms of acceptance of the Children's Textile Flammability Test Certificate so that clothing textiles that have been tested and certified to be eligible do not need to undergo unnecessary retesting.

In August 2010, the Consumer Product Safety Commission issued an announcement detailing the accreditation standards and procedures of third-party conformity assessment bodies for the 16 CFR Part 1610 flammability standards, and withdrawing the relevant child product testing and certification suspension orders.

Therefore, any children's apparel textiles produced after November 16, 2010 must be tested by a third party conformity assessment agency approved by the Consumer Product Safety Commission and issued a certificate of conformity according to the test results.

In addition, the Consumer Product Safety Commission will, in a variety of circumstances, accept retroactive tests or third party conformity assessment agencies for testing prior to their approval. For example, the test must be conducted on or after August 18, 2010, and a third-party accreditation body must be accredited by the board before October 18, 2010.

According to the Consumer Product Safety Commission, depending on the characteristics of the garment industry, there may be a large time gap between cloth testing and garment making. Therefore, some products may need to be tested again if they are tested before the accredited laboratory of the association has received accreditation. In order to reduce repetitive testing, the Consumer Product Safety Commission will accept tests conducted by a third-party quality assessment agency before it is accredited under the following circumstances.

When a third-party conformity assessment agency conducts product testing, it has obtained ISO/IEC 17025 certification issued by a signatory member of the International Laboratory Accreditation Cooperation's multilateral mutual recognition agreement.

Applications submitted by third party conformity assessment agencies for testing using the 16 CFR part 1610 test method were accepted by the Consumer Product Safety Commission on or before November 16, 2010.

The product was tested on 16 CFR part 1610 on or before August 18, 2009.

When testing, the valid certification scope of a third-party conformity assessment agency clearly includes the 16 CFR part 1610 test.

The test results show that the product complies with the current applicable standards and/or regulations.
